The Law Office of Heather Beverly, P.C. is honored to assist our clients with the many complexities of protecting the assets and rights of entertainers and creatives while they are building their legacies and their heirs who inherit the assets (and responsibilities associated with them) once their loved one has passed. The needs of entertainment clients in estate planning are unique. Copyright protection exists for the life of the copyright owner plus 70 years. In some states, the same holds true for rights of publicity. Royalties and residuals are inheritable assets. Songs, books, films, recordings, and other creations have “life” beyond the death of their creators and owners. Thus, there are many matters to consider when dealing with the entertainment client’s estate matters.

Although we are not estate attorneys, we work closely with our clients’ estate planners and representatives to ensure that they incorporate and consider the specific issues related to the entertainment industry assets and income streams. And, while working directly with our clients, we educate them on legacy and estate related considerations that should be kept in mind from the earliest stages of their careers. For our clients who are heirs to a legacy estate, we are a source of advice and counsel throughout their process of identifying and aggregating assets, contacting rights holders, obtaining, and submitting relevant documentation to claim their respective shares of royalties. Our firm also assists heirs with the ongoing legal issues involved with managing the assets they have inherited including acquisition or renegotiation of existing contracts related to the assets, aggregation, cataloging and exploitation of assets and rights and other business related thereto.
